An Alabama death row inmate charged with capital murder in Texas has had that case dismissed.

Oscar Doster escaped from the Covington County Jail in March of 2005.

56-year-old Dennis Courtney was beaten and shot to death a week later near Oakwood, Texas.

Doster was finally apprehended in California.

A Texas appeals court dismissed the capital murder charge because Doster did not stand trial within 120 days, even though defense attorneys requested and received extra time to prepare their case.

Doster has already been convicted and sentenced to die for killing an Alabama man when he escaped from the Covington County jail in 2002.
