Charges are being dismissed in the case of three men accused of conspiring to kill a Dale County judge and an Ozark attorney.

District Attorney Kirke Adams announced Monday that he's filed motions to dismiss charges against Garrett Wayne Daniels and Fred Daniels.

The Daniels were accused of being conspiring to kill Circuit Judge Kenneth Quattlebaum and Attorney Buddy Williams.

Andrew Earl Garner is the alleged hit-man and charges against him will be reduced to conspiracy to commit second-degree assault.

Adams says there is no corroborating evidence that any of the men were planning a murder.

The DA's order filed with the court says, "The DA has determined at this point there is no credible corrobating evidence to substantiate a reasonable liklihood conviction in state court." Again, there is evidence, as Garner is being charged. However, the Daniels have gotten off on a technicality. DA doesn't think he can get a conviction so he's turning them loose now. The issue isn't did they do it. But, can you prove it without a shadow of a doubt. Pretend your house is robbed. No one saw the crime or robber, is your house not robbed because there is no evidence of who committed the crime? Or one person saw it but there is no one to back up his testimony of who it was. That would be corrobating evidence. However, the crime remains, your house is still robbed. You are a victim with the criminal going free. Does that give you some peace of mind? All you would be thinking about is that someone got away with doing something wrong, not whether several people could verify it.

THE JUDGES AND LAWYERS SEE HOW THE LEGAL SYSTEM NOW .I WOULD NOT TRUST A LAWYER OR A JUDGE IN THIS STATE NONE.

....I heard the DA say that there was NO evidence...what report did you listen to?? It is my opinion that what goes on in Dale County pretty much goes on in most places. Most of the time, it is who you know and how much money you have... I am amazed at what some people will do and what lengths some people will go to, to hurt their former spouses in a divorce case. This is what this is about really. If for one minute the parties in this case would consider the children and what their actions are doing to them. I never can understand...these people loved each other at one time...and made these children together. It is disgusting how they tear each other apart. And don't get me started on unscrupulous lawyers just working the fire for their own greedy purposes! I hope all these people wake up.

There was plenty of evidence against Fred and Garrett Daniels. Just because they were released doesn't mean they aren't guilty. Sometimes, guilty people go free because of something that should be insignificant. Look at OJ. Everybody knows he was guilty and he walked. Did that make him less guilty? Judy, tell everyone Fred is your brother and Mike Trent is your live in since you both have so much to criticize South Alabama about.

There can be no justice in Dale County for the Daniels' when a Sheriff can dictate to a District Attorney and hold innocent men in jail (with not evidence - only hear-say). I'm still outraged the D.A. could hold these men in jail since February - pretend he just got evidence from the FBI on Friday - look the public in the face and say he couldn't sleep at night not making the right call. The call was already made for him as he was going to be forced to give up the empty bag by Wednesday. There maybe others in Dale County Jail suffering as innocent victums just like the Daniels' - with made up lies against them, with judgements that are superficial, with attorneys that are greedy fir money - power - or fame. How sad our judicial system has stooped. The people in Dale County need to get their money back on their elected officals, have an investigation on who pays whom for what- something is seriously wrong down there.
