Saturday night, two brothers broke into a home on Route 84 East in Cowarts. One was shot and killed by the homeowner, and the other suspect made his first court appearance before a Houston County magistrate.

Twenty-three-year-old Christopher Dunlap has been charged with first degree burglary and did confess.

Judge Lawson Little has him set at $200,000 dollar bond.

Dunlap's family is going to provide him with an attorney, who can then put in a request for a preliminary hearing.

Meanwhile, authorities say the shooting appears to be a justifiable homicide, but the case will be presented to a grand jury for review.

"The investigation takes a while because we wanna’ make sure what we have is factual from the info we receive from the suspects and the info from the victim,” Captain Antonio Gonzalez, with the Houston County Sheriff's Office said. “Plus, the evidence; once the info is recovered, we pile it all together, and make sure we have a picture shown to the grand jury in reference to what happened. They determine what happens at that point."

Because the state of Alabama has what is called a "Castle Law", Peter Webb, the homeowner, had the right to protect his home, even if that means using violent force.

There are no court dates scheduled, and the case is still under investigation.
